Abstract

Objective: To analyse the profile of the legal proceedings that demand the supply of medicines and health products filed against the city of Fortaleza, CE. Methods: A descriptive and quantitative cross-sectional study. The data obtained were collected at the Municipal Pharmacy Assistance. Included in the study were processes that demanded standardized and non-standardized drugs and products for health maintenance in the period from January 2017 to October 2017. Results: The majority of the beneficiary patients were female (52%). Adults (38.46%) and elderly (37.69%) were the predominant age group. The municipality as defendant represented 88% of the cases. The anticipation of emergency care was granted in 97% of the cases. Most of the medical prescriptions showed a link with the public health system and 53% of the medicines were not prescribed in their generic name. The two anatomical groups representing more than 60% of the adjudication of the drugs (digestive tract and metabolism and nervous system). Geriatric disposable diapers demanded most of the health products (26%). The purchase of medicines to comply with court orders generated a budget loss of 147% when compared to the maximum allowed price for sales (Factory Price). Conclusion: The request for medicines by judicial means generate a high cost for the municipal pharmaceutical assistance, since several drugs were found that belong to the basic component of pharmaceutical care.
